1. Application and acceptance

These Terms & Conditions apply to HIB Fitness memberships, bookings, classes, courses, facilities, services, website and app usage.

By purchasing a membership or service, making a booking, or using HIB Fitness facilities, you agree to these Terms & Conditions and any reasonable facility rules and policies notified to you.

2. Memberships

Memberships are personal to the registered member and may not be transferred, shared or used by another person unless HIB Fitness expressly agrees otherwise.

Members must provide accurate and up-to-date registration and contact information. Membership benefits, access rights and booking privileges are subject to the package purchased.

3. Membership term, renewal and cancellation

The duration, price, payment frequency, renewal arrangements and any minimum term will be shown at the point of purchase or in the applicable membership offer.

Where a membership renews automatically, the renewal arrangement and cancellation requirements should be clearly presented before purchase.

Cancellation requests must follow the method and notice period stated for the relevant membership. Nothing in these Terms limits statutory consumer rights, including rights that may apply where services are not supplied as agreed.

4. Payments

Membership fees and other charges must be paid when due. Members are responsible for maintaining valid payment details.

Where recurring payments are authorised, HIB Fitness or its payment service provider may collect the agreed amount in accordance with the membership terms. Failed or overdue payments may result in temporary suspension of access while the account is brought up to date.

5. Bookings, cancellations and no-shows

Classes, courses, pool sessions and other activities are subject to availability, capacity and the booking rules displayed at the time of booking.

Members should cancel within the applicable cancellation window. Late cancellation or non-attendance may result in loss of a booking entitlement, credit or fee where this is clearly stated in the relevant booking policy.

HIB Fitness may cancel, relocate or reschedule activities where reasonably necessary. Where a paid service is materially affected, HIB Fitness will provide an appropriate remedy in accordance with applicable consumer law.

6. Facility access and conduct

  • Follow reasonable instructions from HIB Fitness staff.
  • Treat staff, members and visitors with respect.
  • Use equipment and facilities safely and only for their intended purpose.
  • Comply with hygiene, safety, supervision and emergency requirements.
  • Do not engage in behaviour that is unsafe, abusive, disruptive, fraudulent or damaging to property.

HIB Fitness may restrict or suspend access where reasonably necessary for safety, security, non-payment, serious misconduct or repeated breaches of facility rules, subject to applicable law and the circumstances of the case.

7. Children and young people

Age restrictions may apply to certain facilities, equipment, classes and services. Where parental or guardian consent or supervision is required, it must be provided in accordance with HIB Fitness policy.

8. Health and fitness

Members are responsible for considering whether an activity is appropriate for their health and fitness level and for following the HIB Fitness Health & Safety Policy.

Where relevant to safe participation, members should inform HIB Fitness of health matters that staff reasonably need to know and should seek medical advice where they are unsure whether an activity is suitable.

9. Personal belongings

Members are responsible for their personal belongings. Lockers should be used where available. HIB Fitness does not exclude or restrict liability where doing so would be unlawful.

10. Website, app and account security

Members must keep account credentials secure and should not permit another person to use their account. HIB Fitness may suspend account access where misuse, fraud or a security concern is reasonably suspected.

Temporary interruption may occur due to maintenance, third-party services, network availability or technical incidents. HIB Fitness will take reasonable steps to restore affected services.

11. Changes to facilities and services

HIB Fitness may make reasonable operational changes to timetables, instructors, opening hours, equipment, facilities or procedures. Material changes affecting a paid service will be handled in accordance with applicable consumer rights and the relevant membership terms.

12. Personal data

Personal information is processed in accordance with the HIB Fitness Privacy Policy and applicable data-protection law. Health information, where processed, is treated as sensitive information and subject to additional safeguards.

13. Liability

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

Members are responsible for following safety instructions, using equipment appropriately and acting within their own abilities.

14. Complaints

Questions, complaints or concerns should be raised with HIB Fitness management as soon as reasonably possible so they can be investigated and addressed.

15. Changes to these Terms

HIB Fitness may update these Terms where reasonably necessary. Material changes will be communicated where appropriate and will not remove statutory rights.

16. Governing law

These Terms are governed by the laws of Ireland. Nothing in this clause prevents a consumer from relying on any mandatory rights available under applicable law.
